These Terms of Service ("Terms") constitute a legally binding agreement between you ("the customer," "you," or "your") and Brampton Bazaar ("we," "us," or "our"), governing your access to and use of our website, mobile applications, and any related services (collectively, the "Platform"). By accessing or using the Platform, placing an order, or creating an account, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.
If you do not agree with any part of these Terms, you must immediately discontinue your use of the Platform. We reserve the right to update or modify these Terms at any time, and your continued use of the Platform following any such changes constitutes your acceptance of the revised Terms.
To use our Platform and make purchases, you must be at least eighteen (18) years of age, or the age of majority in your jurisdiction, whichever is greater. By using the Platform, you represent and warrant that you meet this eligibility requirement. If you are under the age of majority, you may only use the Platform with the involvement and consent of a parent or legal guardian.
When you create an account with Brampton Bazaar, you agree to provide accurate, current, and complete information as prompted during the registration process. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
Brampton Bazaar reserves the right to suspend or terminate your account at any time, with or without notice, if we determine that you have violated these Terms, engaged in fraudulent activity, or otherwise acted in a manner that is harmful to our business, our customers, or third parties.
Brampton Bazaar makes every reasonable effort to ensure that product descriptions, images, specifications, and pricing displayed on the Platform are accurate and up to date. However, we do not warrant that product descriptions or other content on the Platform are error-free, complete, or current. In the event of an error in a product listing, we reserve the right to correct the error and, if necessary, cancel any orders placed at the incorrect price or based on inaccurate information.
All prices displayed on the Platform are in Canadian Dollars (CAD) and are subject to applicable taxes, which will be calculated and displayed at checkout. Prices are subject to change without notice at any time prior to the placement of an order. Once an order has been confirmed and payment has been processed, the price at the time of purchase will be honoured, subject to the exceptions described in these Terms.
Product availability is not guaranteed. We reserve the right to limit the quantity of any item that may be purchased by a single customer or household, and to discontinue any product at any time without notice. In the event that an item becomes unavailable after your order has been placed, we will notify you and offer a full refund of the amount paid for the unavailable item.
Product images displayed on the Platform are for illustrative purposes only. Actual products may vary slightly in appearance, colour, or packaging from the images shown, particularly due to differences in monitor settings and display technology. Such variations do not constitute a defect or grounds for return.
Placing an order through our Platform constitutes an offer to purchase the selected items at the stated price, subject to these Terms. An order is not confirmed until you receive an order confirmation email from Brampton Bazaar. We reserve the right to accept or decline any order at our sole discretion, including but not limited to cases involving suspected fraud, pricing errors, or stock unavailability.
Once an order has been confirmed and processing has commenced, it may not be possible to cancel or modify the order. If you wish to cancel or change an order, please contact our support team as soon as possible. We will make reasonable efforts to accommodate your request, but we cannot guarantee that changes can be made once fulfillment has begun.
By placing an order, you confirm that all information provided — including your name, delivery address, and payment details — is accurate and complete. Brampton Bazaar is not responsible for failed or delayed deliveries resulting from inaccurate information provided at the time of ordering.
Payment for all orders must be made in full at the time of purchase using one of the accepted payment methods displayed at checkout. By providing your payment information, you represent and warrant that you are authorized to use the payment method provided and that the information you supply is accurate and complete.
All payment transactions are processed through secure, PCI-DSS compliant third-party payment gateways. Brampton Bazaar does not store your full credit card or debit card details on our servers. While we take all reasonable precautions to ensure the security of your payment information, we cannot be held liable for any loss or damage arising from unauthorized access to your payment details that occurs through no fault of our own.
In the event of a fraudulent transaction or unauthorized use of your payment method, you must notify your financial institution immediately and contact our support team. Brampton Bazaar will cooperate with any investigation conducted by your financial institution or law enforcement authorities.
Our Returns, Exchanges & Refunds Policy, which is published separately on this Platform, is incorporated into these Terms by reference and forms an integral part of this agreement. By placing an order, you acknowledge that you have read and understood our return policy, including the strict five-day return window, the exchange-only nature of approved returns, and the categories of non-returnable items.
Brampton Bazaar's liability in connection with any order is strictly limited to the purchase price paid for the item(s) in question. We are not liable for any incidental, indirect, special, consequential, or punitive damages arising from or related to your purchase, including but not limited to loss of use, loss of profits, or loss of data, even if we have been advised of the possibility of such damages.
You agree to use the Platform only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit their use and enjoyment of the Platform. You must not use the Platform to transmit any unsolicited commercial communications, to engage in any fraudulent or deceptive activity, or to upload or transmit any content that is defamatory, obscene, offensive, or otherwise objectionable.
You must not attempt to gain unauthorized access to any part of the Platform, to the server on which the Platform is stored, or to any server, computer, or database connected to the Platform. You must not attack the Platform via a denial-of-service attack or a distributed denial-of-service attack.
Brampton Bazaar reserves the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision, including without limitation, reporting such users to law enforcement authorities.
All content on the Platform, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the exclusive property of Brampton Bazaar or its content suppliers and is protected by Canadian and international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial purposes only. This licence does not include the right to reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Platform, except as incidental to normal web browsing.
Any unauthorized use of our intellectual property is strictly prohibited and may result in civil or criminal liability. If you believe that any content on the Platform infringes your intellectual property rights, please contact us immediately with the details of your claim.
The Platform and all content, products, and services made available through it are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, Brampton Bazaar disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Brampton Bazaar does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components, or that defects will be corrected. We do not warrant or make any representations regarding the use or the results of the use of the materials on the Platform in terms of their correctness, accuracy, reliability, or otherwise.
To the maximum extent permitted by applicable law, Brampton Bazaar, its directors, officers, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, service interruption, computer damage, or system failure, arising out of or in connection with your use of the Platform or the purchase of products, even if Brampton Bazaar has been advised of the possibility of such damages.
In no event shall Brampton Bazaar's total liability to you for all claims arising out of or relating to these Terms or your use of the Platform exceed the total amount paid by you to Brampton Bazaar in the twelve (12) months preceding the event giving rise to the claim.
These Terms and any disputes arising out of or relating to them or your use of the Platform shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. You agree to submit to the exclusive personal jurisdiction of the courts located in Ontario, Canada for the resolution of any disputes.
Before initiating any formal legal proceedings, we encourage you to contact us directly to attempt to resolve the dispute informally. We are committed to addressing customer concerns fairly and promptly, and many issues can be resolved through direct communication with our support team.
If a dispute cannot be resolved informally, either party may pursue their legal remedies through the courts of Ontario. Nothing in these Terms shall prevent either party from seeking injunctive or other equitable relief in any court of competent jurisdiction where necessary to protect their rights or interests.
